4- Description of the Services
SafetyMails provides an e-mail validation and verification service to help companies improve the accuracy and reliability of their contact lists. Our technology detects invalid, disposable or risky addresses, reducing bounce rates, helping to prevent fraud and contributing to improved deliverability.
In addition to e-mail verification, SafetyMails also offers solutions related to e-mail marketing, including:
Email Finder – This service seeks to identify the most accurate professional contact e-mail of an individual, based on their name and corporate domain, supporting the CUSTOMER’s outreach and communication efforts.
Email Tester – This service is intended to perform a diagnosis that evaluates the technical quality of e-mail campaigns, analyzing authentication settings (SPF, DKIM, DMARC, among others), spam scores, HTML structure and other technical parameters that affect deliverability (inbox placement).
4.1- E-mail Verification
E-mail verification is the technical process that evaluates the existence, validity and reliability of e-mail addresses in a contact list. After an e-mail list is uploaded, through a series of tests, the verification identifies invalid, inactive or risky addresses (such as spamtraps and temporary e-mails), allowing the CUSTOMER, together with the adoption of complementary good practices, to improve the delivery and deliverability of e-mail campaigns.
The verification of an e-mail list will only be performed if there is a sufficient amount of credits available in the CUSTOMER’s account.
4.1.1- Criteria for the e-mail validation and verification process
SafetyMails performs e-mail validation and verification according to internal criteria based mainly — although not exclusively — on the standards established in various RFCs (Request for Comments), as well as any subsequent or complementary technical documents that may update or replace those standards and guidelines.
At its sole discretion, SafetyMails may employ a variety of verification processes and public verification, as well as complementary tools and technologies, to increase the accuracy and reliability of its services.
SafetyMails continually strives to minimize the occurrence of invalid e-mail classifications and to maximize the overall accuracy and efficiency of the CUSTOMER’s e-mail lists.
However, the Service remains subject to external network or server conditions that may occasionally cause query failures beyond the control of SafetyMails.
All methodologies, algorithms and processes used by SafetyMails in carrying out its verification activities are considered confidential and proprietary business information, protected by applicable trade secret laws.
The CUSTOMER acknowledges and agrees that:
- It is common market practice for e-mail sending platforms (and related ones) to apply their own antispam filters, blocking rules or categorization mechanisms that may classify technically valid e-mail addresses as “hard bounces” or similar statuses.
- Such filtering rules are exclusive to each platform and are neither publicly disclosed nor known to SafetyMails, which is therefore exempt from any liability for rejections or classifications resulting from these independent mechanisms.
- Such classifications do not constitute proof that an e-mail address is invalid or non-existent.
- The non-existence of an e-mail address is normally demonstrated — although not exclusively — through standardized SMTP responses, such as error code 550 (“Requested action not taken: mailbox unavailable”, “The e-mail account you tried to reach does not exist” or “The e-mail account you tried to reach is disabled”).
- Data, reports or results provided by competing verification platforms cannot be used as valid references or benchmarks to evaluate or contest the results of SafetyMails, since each provider operates using distinct proprietary methodologies, databases and algorithms.
4.1.2- E-mail Verification Reports
SafetyMails will process an e-mail list entered into its platform in a timely manner in order to meet the quality criteria set forth in this agreement.
The time required to verify an e-mail list may vary from a few minutes to a few hours. For this reason, SafetyMails offers two types of reports:
- Basic Report / Preliminary Analysis: a quick analysis with preliminary information. There are e-mail addresses that have not been evaluated and will require a process with more steps for verification, obtained in the following deep analysis phase.
- Deep Report / Deep Analysis: the final analysis report of an e-mail list, covering the entire e-mail list.
The possible results of the e-mail validation and verification service are based on the assessment of SafetyMails, which will use the processes it considers safest and the tools it adopts as a qualitative parameter.
The complete list of analyzed e-mail statuses can be found in the SafetyMails help documentation.
SAFETYMAILS IS EXEMPT FROM THE OBLIGATION TO ACHIEVE 100% ACCURACY IN THE RESULTS REPORTED, CONSIDERING THAT E-MAIL SERVICE PROVIDERS AND/OR COMPANY IT DEPARTMENTS IN GENERAL MAY USE EXTRAORDINARY RESOURCES THAT SUBJECT THE RESULTS TO FALSE POSITIVES OR THE REHABILITATION OF E-MAIL ADDRESSES IN DISUSE, AMONG OTHERS.
The decision to use e-mail addresses in e-mail campaign sends, especially in the case of addresses classified at any risk level (for example, disposable, temporary, spamtraps, among others), rests solely with the CUSTOMER, releasing SafetyMails from any losses resulting from the use of such e-mail addresses.
For security reasons and to fight SPAM, SafetyMails identifies, but does not individually disclose, e-mail addresses classified as Spamtraps, counting them numerically in the reports and categorizing them as “invalid” in the final exported file, and it is up to the CUSTOMER to remove these addresses.
4.2- API Usage
The SafetyMails API service allows the CUSTOMER to integrate, into its own systems or digital environments, an integration code provided by SafetyMails, capable of performing real-time e-mail address verification and validation queries.
The operation of the API is conditional upon the existence of an active credit subscription plan. If the subscription is cancelled or expires, the service will be automatically deactivated.
API requests will only be answered if there are credits available in the CUSTOMER’s account.
The API is advisory in nature, returning only the status of the e-mail queried directly by the CUSTOMER. SafetyMails does not store additional data that may be contained in forms (such as name, company or phone number).
The installation and configuration of the integration code are the sole responsibility of the CUSTOMER.
Due to its flexible nature, the CUSTOMER acknowledges that any automatic blocking in forms or systems, based on the results returned by the API, is optional and entirely the CUSTOMER’s responsibility.
For protection against misuse, the API provides configurable security mechanisms, such as restriction by domain, URL or IP address. It is the CUSTOMER’s responsibility to configure, manage and maintain these restrictions.
SafetyMails establishes request limits to ensure the stability of the service. These limits vary according to the contracted credit plan and can be consulted in the following table:
| Contracted monthly plan | Connection limit per hour | Connection limit per minute |
|---|---|---|
| 1,000 credits | 100 | 10 |

When any limit is exceeded, the system will return an alert message via API, informing of the restriction.
The CUSTOMER may upgrade its plan to increase usage limits, according to the conditions and prices available at panel.safetymails.com.
If the maximum hourly request limit of the CUSTOMER’s account is exceeded, SafetyMails may apply an automatic temporary block, discarding new connections and responses for a period of up to 6 (six) hours.
It is expressly prohibited to use the API for improper purposes or purposes contrary to e-mail marketing best practices — including, among others, DHA (Dictionary Harvest Attack).
The detection of misuse authorizes SafetyMails to apply the penalties provided for in these Terms of Use, including the suspension or permanent cancellation of the account.
4.3- Email Finder
The Email Finder is a service that helps professionals and companies identify and establish e-mail contact with potential customers.
By entering a professional’s first and last name and the company’s corporate domain, the System seeks to locate a valid corporate e-mail address, enabling direct communication in exclusively B2B contexts.
In this feature, SafetyMails does not search for or validate personal e-mail addresses, respecting individual privacy and data protection legislation.
The search for an e-mail address will only be performed if there is a sufficient amount of credits available in the CUSTOMER’s account.
Although SafetyMails uses its best technical efforts to locate and validate addresses, there is no guarantee that all requested records will be found, nor that the CUSTOMER will succeed in making contact or establishing any subsequent business relationship.
4.4- Email Tester
The Email Tester is a technical and advisory analysis service aimed at e-mail marketing actions. It works by sending an e-mail to the e-mail address provided by SafetyMails in the CUSTOMER’s account.
It evaluates multiple parameters that influence the deliverability and technical performance of messages, including authentications, antispam scores, blacklists, HTML code integrity and hyperlink status.
The e-mail test will only be performed if there is a sufficient amount of credits available in the CUSTOMER’s account.
During the diagnostic process, SafetyMails performs checks that involve, among other aspects:
- DNS configurations and authentications (SPF, DKIM, DMARC, ARC, MX, SOA);
- Antispam score, based on the SpamAssassin tool;
- Hyperlink analysis and detection of shortened URLs;
- Evaluation of HTML weight and the presence of ALT attributes in images.
The system presents a qualitative score from 0 to 100 points, calculated from the results obtained. Higher scores indicate a lower risk of delivery failures or blocks resulting from the criteria evaluated.
The results displayed reflect the technical conditions in effect at the time of the test and do not guarantee that they will remain valid afterwards, since external parameters may change. Each new e-mail sent to the address provided by SafetyMails, even if identical to a previous one, will be considered a new test and will count toward the consumption of the credits available in your account.
The e-mail viewer provides a simulated rendering of the message, and there may be variations from the actual display on different devices, e-mail clients or user settings.
The test is informative in nature and does not guarantee the delivery or deliverability of the e-mail campaign, nor the absence of antispam blocks.
The CUSTOMER acknowledges that actual delivery depends on several factors, including sender reputation, historical behavior and the policies of e-mail providers, which are outside the sphere of influence of SafetyMails
4.5- About the Use of Artificial Intelligence
SafetyMails may, occasionally, introduce services, features or functionalities as part of its Services, based on Artificial Intelligence (AI), Machine Learning or similar technologies.
This technology will be made available by a third-party service provider engaged by SafetyMails.
The CUSTOMER acknowledges that all content submitted to be processed by the AI will grant SafetyMails a worldwide, non-exclusive, royalty-free and irrevocable right to use, process, copy, reproduce, modify, derive, translate, publish, display and distribute as necessary to operate, enhance, improve and develop SafetyMails and the AI and to provide the Services.
The CUSTOMER is responsible for any AI content, including its accuracy, quality, suitability and legality.
THE CUSTOMER RELEASES SAFETYMAILS FROM LIABILITY FOR THE RESULTS OBTAINED THROUGH THE USE OF AI AND FOR DIRECT, INDIRECT OR INCIDENTAL DAMAGES, UNDERSTANDING THAT THE AI MAY NOT MEET THE CUSTOMER’S INTENDED USE AND MAY PRODUCE IMPERFECTIONS AND INACCURACIES. THE AI WILL BE PROVIDED “AS IS”, WITHOUT ANY INDEMNITY OR WARRANTY OF ANY KIND, AND MAY BE CHANGED, DISCONTINUED OR CANCELLED AT ANY TIME AND FOR ANY REASON, AT THE SOLE DISCRETION OF SAFETYMAILS.
5- Free Trial Period
SafetyMails, at its sole discretion, allows the CUSTOMER to use its Services free of charge, limited to the number of credits available in its account.
The amount of credits made available free of charge to the CUSTOMER is at the discretion of SafetyMails.
SafetyMails may, at any time, change or discontinue the provision of free credits for the purpose of free trial.
6- About Credits
Credits are the currency used to use the SafetyMails services. To acquire credits for its account, the CUSTOMER must make a one-time credit purchase or a recurring credit purchase subscription.
6.1- Credit Usage
Each service consumes a certain number of credits, as follows:
E-mail verification: each 1 e-mail address verified consumes 1 credit, except in cases classified as “Pending”, in which SafetyMails returns the credit to the CUSTOMER’s balance.
Repeated e-mail addresses also consume validation credits, and it is the CUSTOMER’s responsibility to remove duplicate records before sending the e-mail file to SafetyMails.
Real-time e-mail verification (API): each 1 e-mail address verified consumes 1 credit, except in cases classified as “Pending”, or those in which SafetyMails is in a period of downtime for any reason, when no credits will be charged.
It is important to note that the mere existence of available credits in the CUSTOMER’s account does not validate the use of the API service, for which an active credit subscription is mandatory.
Email Finder: each test consumes 7 (seven) credits, if successful. If the e-mail found is invalid, catch-all or reject-all, it will consume 1 (one) credit. If the result is inconclusive, it will not consume credits.
The CUSTOMER may purchase credits independently of its credit subscription in order to supplement the available balance.
Email Tester: each test consumes 100 (one hundred) credits, regardless of the result obtained.
6.1.1- About Available Credits
The responsibility for maintaining the amount of credits available in the account for the full operation of the system lies with the CUSTOMER.
SafetyMails may offer the CUSTOMER credit consumption reports and notices when credits are insufficient or absent.
6.2- Credit Refunds
SafetyMails does not provide cash refunds for credits not used by the CUSTOMER.
The transfer or donation of credits between accounts is not permitted, even if they belong to the same company or group.
In the e-mail list verification service, the CUSTOMER may receive a partial refund in the form of credits, only when, at the end of the full processing of a list, with release of the Deep Report, and after all verification attempts by SafetyMails have been exhausted, there are records categorized as “Pending”.
In these cases, the amount of credits corresponding to these records will be automatically returned to the balance of the CUSTOMER’s account.
If the CUSTOMER chooses to interrupt the processing of an e-mail list that has the status “Basic Report / Preliminary Analysis”, the addresses classified as “Pending” after the file is closed by the system will be credited to the balance of the CUSTOMER’s account.
6.3- Validity of credits
The credits available in the CUSTOMER’s account are valid for 1 (one) year from the date of their acquisition.
SafetyMails may, at its sole discretion, reduce, extend or disregard this validity period, keeping the credits active in the CUSTOMER’s account for as long as it deems appropriate.
In the event of permanent termination of the activities or services of SafetyMails, all remaining credits will become immediately unavailable, with no right to refund or compensation, regardless of the remaining validity period.
7- Payments
To purchase credits (one-time or recurring) for its account, the CUSTOMER must provide SafetyMails with accurate and complete billing information, including name, corporate name, location data (such as address and country), postal code (if applicable), tax registration (CPF, CNPJ, EIN, Tax ID, TIN, NIG, VAT, UTR, or any other similar one corresponding to your country), telephone number and credit card (if applicable).
The CUSTOMER acknowledges that tax documents will be issued with the registered information, and undertakes to ensure that this information is correct.
7.1- Credit Prices
The CUSTOMER agrees to pay for the services according to the price tables in force, available on the website www.safetymails.com and in the user dashboard at panel.safetymails.com.
SafetyMails may adjust the prices of its services at any time, with the aim of maintaining the sustainability and continuous improvement of the Services.
These adjustments may cover both credit purchases and monthly subscriptions, in whole or in part.
In cases of price adjustments in subscription plans, the changes may be applied to all active contracts or only to new contracts, at the sole discretion of SafetyMails, which undertakes to notify active CUSTOMERS in advance before the new conditions take effect.
7.2- Credit Subscription
The CUSTOMER may opt for a credit subscription, a modality that consists of an automatic monthly credit top-up, with a fixed amount and scheduled recurrence.
The annual payment modality may also be chosen. In this case, due to the promotional and prepaid nature of the contract, there will be no refund of any kind in the event of cancellation or withdrawal at the CUSTOMER’s initiative.
The CUSTOMER will receive, each monthly cycle, the amount of credits contracted, provided that payment is made by the due date.
Failure to pay on time will result in the automatic cancellation of the subscription, with the loss of any promotional benefits granted (such as discounts or bonuses) and subjection to the price table in force upon a new contract.
7.1.2- Automatic credit top-up
To avoid the interruption of API queries due to a lack of available credits, the CUSTOMER may activate the Automatic Credit Top-up service.
Unlike the Credit Subscription, the Automatic Top-up can be configured and triggered at any time, according to the CUSTOMER’s preferences.
The top-up trigger is defined by the CUSTOMER, who determines the minimum credit level in the account and the amount of credits to be automatically purchased when that threshold is reached.
Example: when the balance falls below 10,000 credits, the system will automatically purchase an additional 5,000 credits.
The exclusive payment method for the Automatic Top-up service is Credit Card.
7.3- Payment Methods
Payments must be made by the CUSTOMER using the payment methods made available by SafetyMails according to the country of origin of the transaction.
Payment processing is intermediated by financial institutions and specialized companies duly engaged by SafetyMails.
The tax document corresponding to the transaction will be issued only after SafetyMails confirms receipt of the funds through the banking system.
The tax document will be available for consultation and download directly in the CUSTOMER’s account.
8- Service Level Agreement (SLA)
8.1- Service Availability
SafetyMails makes every effort to maintain server uptime above 97%, although this is not an obligation and is a condition subject to force majeure. You can check the current status and uptime/downtime periods of SafetyMails at https://status.safetymails.com/.
The maximum time for processing an e-mail list is up to 24 (twenty-four) hours. After that, the process is automatically terminated.
8.2- Maintenance and Backup
SafetyMails performs automatic maintenance and backup procedures daily, between 3 and 4 a.m. (São Paulo / UTC-03). This may cause delays, intermittency and/or absence of responses to queries made through the API during that period.
8.3- Interaction with Third Parties
SafetyMails may contain links to third-party websites or services that are not owned or controlled by SafetyMails.
When they are part of services offered by SafetyMails, the CUSTOMER acknowledges and accepts that the services will be used and understands that any unavailability of these services is beyond the control of SafetyMails.
When using optional third-party services (if any), the CUSTOMER represents and warrants that it has read and agreed to all applicable policies and Terms of Use of the third parties, and that it does so at its own risk, expressly releasing SafetyMails from any and all liability arising from the use of any third-party website.
8.4- DISCLAIMER OF LIABILITY
SAFETYMAILS IS NOT RESPONSIBLE FOR ANY DECISIONS, ACTIONS OR RESULTS ARISING FROM THE WAY THE CUSTOMER USES THE INFORMATION OBTAINED THROUGH ANY OF ITS SERVICES.
THIS INCLUDES, BUT IS NOT LIMITED TO, INCORRECT USE OF THE PLATFORM, API SETTINGS, INTERPRETATION OR APPLICATION OF THE RESULTS PROVIDED AND ANY COMMERCIAL OR OPERATIONAL IMPACTS GENERATED FROM SUCH USE.
SAFETYMAILS MAKES NO REPRESENTATION OR WARRANTY REGARDING ANY CONTENT OR DATA FROM THE ANALYSIS OF E-MAIL ADDRESSES OR E-MAIL-RELATED SERVICES.
SAFETYMAILS IS ALSO NOT RESPONSIBLE FOR TEMPORARY UNAVAILABILITY (DOWNTIME), ACCESS INTERRUPTIONS OR LACK OF API RESPONSE, REGARDLESS OF THE CAUSE, ESPECIALLY WHEN SUCH OCCURRENCES HAVE BEEN COMMUNICATED IN ADVANCE.
UNDER NO CIRCUMSTANCES SHALL THE USER BE ENTITLED TO ANY INDEMNITY, REIMBURSEMENT OR COMPENSATION DUE TO UNAVAILABILITY, COMMUNICATION FAILURE, LACK OF RESPONSE OR COMMERCIAL LOSSES ARISING FROM THE USE OR INABILITY TO USE THE SERVICES.
9- Confidentiality and Secrecy of Information
SafetyMails and the CUSTOMER mutually undertake to keep absolutely confidential all information exchanged between the parties during the term of the contractual relationship, including technical, operational, commercial, legal or any other type of data. Both parties agree to protect such information against unauthorized disclosure and to use it exclusively for the performance of the contracted services.
Each party undertakes not to use confidential information to obtain any type of advantage, direct or indirect, personal or for third parties, present or future.
The parties also undertake not to share personal data with third parties, except with the express consent of the data subject or in the cases provided for by law, and to adopt adequate security, confidentiality and privacy measures in compliance with applicable data protection legislation.
If legally requested by competent authorities, both parties undertake to cooperate and provide the information required, always observing the legal limits and the duty of confidentiality.
SafetyMails, in particular, undertakes to fully preserve the confidentiality of the e-mail address databases and other data sent by the CUSTOMER for processing, refraining from copying, reproducing, selling, renting, sharing or using such information for any purpose other than the provision of the contracted services.
Likewise, the CUSTOMER undertakes to keep confidential all technical information related to the interface, systems, projects, specifications and performance of SafetyMails.
The CUSTOMER must safeguard the security of its access credentials, including logins, passwords, API keys and query URLs, keeping them personal and non-transferable and immediately notifying SafetyMails of any suspected loss, improper access or breach.
It is also the CUSTOMER’s responsibility to ensure that only duly authorized and identified persons in the system have access to its accounts and sub-accounts, and it must notify SafetyMails of any security incident detected.
Confidential information shall be considered all information of a technical, operational, commercial, legal or strategic nature, including, but not limited to: internal processes, formulas, codes, algorithms, specifications, inventions, drawings, layouts, business plans, accounting methods, systems, reports, studies, opinions, research, techniques and know-how, regardless of the medium in which they were obtained — physical, digital, electronic or oral.
Personal information contained in the databases shared with or processed by SafetyMails at the CUSTOMER’s request, such as e-mail addresses, names, documents, addresses and other similar data, is also considered confidential, even though, for the performance of the services, only the e-mail addresses are actually used.
The methods, algorithms and technical criteria employed by SafetyMails in its verification activities are likewise classified as confidential information and trade secrets, and may not be disclosed, reproduced or shared under any circumstances.
The following shall not be considered confidential information:
- that which is already in the public domain without breach of this agreement;
- that which does not fall within the definition above;
- that whose disclosure is determined by court order or competent authority, limited to the scope of the legal obligation;
- the verification statuses of the e-mail addresses queried, which are part of the historical database of SafetyMails and are stored individually, without constituting a sharing of personal data; and
- the aggregated results of queries made by the CUSTOMER, which may be used by SafetyMails in research, market reports, presentations, articles, videos or informational materials, provided that this is done anonymously, without identifying e-mails, individuals or companies, and without violating confidentiality or personal data protection rules.
If SafetyMails is legally required to disclose information originating from the processed databases, it undertakes to notify the CUSTOMER in advance, whenever possible, and to use its best efforts to preserve the confidentiality of the information.
The confidentiality and secrecy obligations set forth in this agreement shall remain in force throughout the provision of the services and for an additional period of 5 (five) years after their termination, regardless of the reason for termination.
